Terms of Service

Read this carefully.

These Terms contain a mandatory arbitration clause and a class action waiver. By using Youth Protocol, you agree to resolve disputes through binding arbitration instead of court. You have 30 days from account creation to opt out (see Section 14).

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Youth Protocol website, mobile apps, and services (collectively, the "Service"), operated by Youth Protocol, Inc. ("Youth Protocol," "we," "us"). By creating an account, completing an intake, or placing an order, you agree to these Terms.

2. What Youth Protocol is — and isn't

Youth Protocol is a technology platform that connects you with US-licensed clinicians and a 503A-licensed compounding pharmacy. Youth Protocol is not a medical practice. The clinicians who review your intake and issue prescriptions are independent practitioners, not employees of Youth Protocol. The pharmacy that fulfills your prescription is an independent entity.

Nothing on our Service constitutes medical advice. The Service is not a substitute for the clinical judgment of your own healthcare provider. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us at security@protocolo.co if you suspect unauthorized access.

5. Subscription terms

FTC Negative Option Rule disclosure: Youth Protocol is a subscription service. By placing an order, you authorize Youth Protocol to charge your payment method automatically at the interval you selected (typically every 60 days) until you toggle off your subscription. You can toggle off at any time from your account.

You may also pause your subscription for 30, 60, or 90 days. Your subscription auto-resumes at the end of the pause. You can toggle off during a pause to cancel entirely.

6. Prescriptions and telehealth

If a clinician issues you a prescription based on your intake, you are establishing a clinician-patient relationship with that independent clinician, separate from Youth Protocol. The clinician may:

Prescriptions are valid for one year from issue, subject to clinician review before each renewal. Refills are automatic within that window unless you toggle off.

7. Payment

Payment is processed by Stripe, Inc. You authorize us to charge your provided payment method for the full amount of each shipment. If a charge fails, we'll attempt to retry and notify you. Repeated failed charges may result in account suspension.

8. Shipping

We ship to US addresses only. Shipping is free. Typical delivery is 3–5 business days after clinician approval. Shipments are packaged discreetly. Signature may be required for prescription products.

9. Refunds and returns

See our Refund Policy. Briefly: compounded medications cannot be returned once shipped (federal law); non-prescription products may be returned unopened within 30 days for a refund.

All Youth Protocol trademarks, logos, the toggle mark, the word "PROTOCOLO," and all site content are the exclusive property of Youth Protocol, Inc. or its licensors. You may not use them without our written permission.

To the fullest extent permitted by law, Youth Protocol's total liability arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. Youth Protocol is not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in this section limits liability for clinician malpractice, which is separately insured by independent clinicians.

14. Dispute resolution

Arbitration

Any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except for small-claims matters.

Class action waiver

You and Youth Protocol agree that each may bring claims against the other only in your individual capacity, not as a plaintiff or class member in any purported class or representative action.

30-day opt-out

You may opt out of arbitration and the class action waiver by sending written notice to legal@protocolo.co within 30 days of creating your account. The notice must include your full name and the subject line "Arbitration Opt-Out."

15. Governing law

These Terms are governed by the laws of the State of [TBD — Delaware if incorporated there], without regard to conflict-of-law principles. Exclusive venue for any non-arbitrated disputes is [TBD by counsel].

We may update these Terms. Material changes will be communicated at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
